General Terms and Conditions

Please read the following booking terms and conditions carefully, as set out in the terms and conditions of the contract between you and Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris Pty Limited. The following terms of use govern the use of the Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris websites. Read these terms and conditions carefully before you accept these Terms by: (a) placing an order and/or an enquiry through the use of any of our contact forms on our Websites, or (b) otherwise using the Websites. If you do not agree with all of these terms and conditions, do not make use of the Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris websites.

Bookings

Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, confirms bookings, except for late bookings, when customers pay a non-refundable deposit equal to a minimum of 35% of the total package price within 24 hours of booking confirmation. At the time of booking, we will inform you about the payment required for your chosen travel arrangements. Please note that nowadays many service providers require 100% pre-payment within 24 hours of confirmation. You must pay the balance of the cost for your travel arrangements no less than nine weeks prior to departure. If you make your booking within nine weeks of departure, you must pay the total cost of your travel arrangements at the time of booking.

Please note: FAILURE TO PAY ON TIME WILL RESULT IN THE AUTOMATIC CANCELLATION OF YOUR BOOKING.

Air/Train tickets

The air/train fare and taxes quoted are current and are subject to change without prior warning should the airline or train travel provider impose an increase in rates for any reason. If the quoted fare is not available at the time of booking, we will book the next applicable fare and inform you about the amended costs. Please note that fares may increase from the time of booking to the time of payment and issuance of the ticket.

Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, cannot hold responsibility if airlines or railway operators discontinue flights or train journeys on specific routings or alter scheduled timetables, leading to missed connections. Should an amendment in routing or itinerary be necessary, any additional costs incurred will not be borne by Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris. The prices and conditions quoted by specific airlines and/or railways determine the airfares and train fares, and Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, cannot guarantee them. The onus is on the agent and the passenger to check that there have been no changes in these prices before making final payment thereof.

Methods of Payment

Credit Cards (Master Card and Visa): In accordance with International Airline Travel Association (IATA) bulletin # A1/00 and our bank ABSA, we need a signed and validated Standard Credit Card Charge Form. The agent acknowledges that they have seen the card or received a copy of the card and that the signature on the card is the same as that on the Credit Card Charge Form. If you have a foreign credit card, we may request you to provide various other details.

Cheques: Bank issued cheques only!Please note that we require 7 working days to clear all cheques before we can issue documents and/or confirm travel arrangements. We accept EFT transfers or cash deposited into one of our bank accounts, on the condition that you provide us with the EFT proof of payment or the cash deposit slip, and we confirm the receipt of such payment. You must make all payments in full and without any bank charges.

Insurance

We consider adequate travel insurance to be essential. You must pay all premiums at the time of booking, as the cover will not be effective until then. Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris will not be liable if anyone should fail to take adequate insurance cover.

Flight/Train Travel Timings

Flight/Train travel timings and other timings are provided by airlines and/or railways and are subject to Air Traffic Control restrictions. All means of transportation are subject to weather conditions, the need for constant maintenance, and the ability of passengers to check-in on time. There is no guarantee that flights, ferries, ships, trains or coaches will depart at the times stated on any itinerary, voucher or tickets which you receive. All timings are estimates only, and we do not accept any liability for any delay, however arising, or for any schedule alterations.

Flight/Train Travel Reconfirmation

It is your responsibility to ensure that you reconfirm the departure date and times of all your flight arrangements and train journeys at least 72 hours prior to departure. This is particularly important in respect of subsequent train journeys in South Africa and flights leaving South Africa. Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris.hereby specifically excludes any liability and cannot be held responsible for any direct, indirect, special, incidental or consequential damages that may arise for any delay and/or travel service provider failure i.e. accommodation needed, car hire, shuttle service and/or any other loss as a result of your failure to reconfirm flight, train journeys and/or connecting flight details.

Documents

We only prepare documents (vouchers, etc.) upon receiving full payment of the package price, and they will be ready 72 working hours after we receive the payment. Should you require hard copies of your documents and air tickets to be forwarded to either yourself or the departure airport and or train station, this may be arranged. These will be sent by e-mail. However, the courier costs in respect thereof will be for your own account.

Passports, Visas and health

The client has the complete responsibility to ensure that all passports and visas are current, valid, obtained on time, and will remain valid for 6 months after returning to the home country. Additionally, the client must ensure that they have obtained any required vaccinations, inoculations, prophylactic treatments (e.g., for malaria), and similar requirements. This also includes all necessary documentation required for travelling with minors. There are specific requirements for children under 18 travelling to South Africa, including but not limited to unabridged birth certificates

Forced Changes to Your Itinerary

We hope and expect to be able to provide you with all of the services we have confirmed to you at the time of booking. We plan arrangements a long time in advance of your holiday using independent suppliers such as hotels etc. over whom we have no control. On some occasions, changes do have to be made, and we reserve the right to make these.

Cancellation Terms

Under our standard cancellation policy, if you cancel your travel prior to 9 weeks of the scheduled date, you will forfeit the full 35% deposit. If you cancel your travel between 9 to 6 weeks prior to the scheduled date, Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris will forfeit 50% of the total cost. If you cancel your travel within 6 weeks of the travel date, Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris will forfeit the entire 100% of the total cost.
